DENVER, CO – A Colorado jury issued a favorable verdict for AbleLight, a nonprofit organization that supports individuals with developmental disabilities. The lawsuit was brought against a former employee and her new employer to protect the confidentiality of information about the people it supports, including HIPAA-protected health information, and its missional work.
On Friday, July 18, 2025, a jury in the District Court of Arapahoe County, Colorado, issued a verdict finding that the former AbleLight employee had improperly taken confidential information about people supported by AbleLight and its work.
The jury found the ex-employee liable for the misappropriation of AbleLight trade secrets and for breaching her legal duty of loyalty by taking the information. No wrongdoing was found on the part of the new employer. The jury awarded nominal monetary damages, and the court issued a permanent injunction barring the use of AbleLight’s confidential information.
“We are grateful that the jury acted to support and protect the principle of confidentiality in our services. This verdict is a powerful affirmation of our values and the trust families extend to us every day,” said Keith Jones, President and CEO of AbleLight. “It is critical to AbleLight’s mission that we treat private information about the people we support and our work with the greatest care and confidentiality. AbleLight will not compromise on this principle.”
